You have your diploma in your pocket, move out of your home and start studying. You will find accommodation in a student hall of residence or in a shared flat. You might even have a room or an apartment all to yourself. But with the new freedom comes new responsibilities. If your parents have taken out private liability insurance, you are usually covered by the family tariff until the end of your studies. However, 15% of German households do not have one. You may therefore have to take care of this yourself in order to be covered in case of damage.

We will answer all important questions about liability insurance and show you how you can protect yourself against third-party claims.

What is liability insurance for students?

A liability insurance for students is a voluntary private liability insurance. It covers you in case you cause damage to others through carelessness for which you are held liable.

What does "liability" mean?

Liability means that you are obliged to accept responsibility for damage caused and to make amends for it.
Section 823 of the German Civil Code (BGB) states on the subject of "liability for damages":"(1) Whoever willfully or negligently violates the life, body, health, freedom, property or any other right of another unlawfully is liable to compensate the other for the resulting damage."

A private liability insurance offers you as a student security in case of claims and demands from other people.

  • Personal injury,
  • Property damage,
  • Financial losses and
  • Unjustified claims.

Why is liability insurance useful for me as a student?

When you start studying, you will probably leave your parents' house for the first time and move to a big city. Everything is exciting and new: the atmosphere on campus, student life, your first own apartment or living together with others in a shared flat. However, with your newfound independence, your responsibilities will also grow. Be sure to check if you are automatically covered by your parents' family liability insurance. This is usually the case until the end of your vocational training. But not all families have taken out private liability insurance and the insurance conditions also differ.

A mishap or accident can happen quickly:
Imagine you were partying late into the night with your classmates and at the end of the party you walk home exhilarated. It's raining. You are tipsy and still thinking about your nightly adventures. When you cross the street, you're not paying attention to the traffic. A car can just about avoid you, but when you try to avoid it, it collides with a moped driver. The moped driver suffers serious injuries. He must be treated in hospital. Afterwards he has to go to physical rehabilitation.

If you cause damage through inattention, you are liable with your entire assets - including your future assets. In the case of personal injury particularly, you could be faced with claims amounting to millions.

The private liability insurance for students at Luko protects you from claims for damages of third parties. Third parties are persons who do not belong to the group of persons covered by the private liability insurance.

The following persons are insured in a private liability insurance at the family rate:

  1. a single person liability insurance, which only protects you, and
  2. a family liability insurance policy that covers other people besides yourself.

  • Your partner who lives with you in a marriage-like community, if they do not have their own private liability insurance and is registered with you,
  • Your / your unmarried children (including stepchildren, adopted or foster children) if at least one of the following conditions applies:
  • The married children or other persons living with you in domestic community (e.g. roommates, grandchildren, parents, parents-in-law, grandparents, brothers and sisters), provided that they do not have their own private liability insurance and are not covered by another private liability insurance and are registered with you at the authorities.

Single liability insurance and family liability insurance

The terms "single" and "family" do not refer to relationship status:

A single student liability insurance policy only covers you as a single person.

Family liability insurance for students covers you as the policyholder and all other persons who live with you in a household and are registered with the authorities.

As a student, am I obliged to take out liability insurance?

No, private liability insurance is one of the voluntary insurance policies. But a private liability insurance is one of the most important insurances of all. Like yourstudent health insurance policy in Germany, which is mandatory upon arrival, and of absolute necessity, your liability insurance (although not mandatory) is of the same level of importance. Both will help you avoid enormous bills while you are away from home.

It might be obvious to save the costs for the insurance coverage. After all, your budget is tight anyway. But, if a damage occurs, a small inadvertence can get you into financial difficulties for exactly this reason. "Failing to plan is planning to fail"! According to this motto, we recommend that you take out private liability insurance. It will only cost you a few euros per month, but in the event of damage it will pay you justified claims up to 30 million euros.

When do I still have family insurance as a student?

It depends with which insurance company and under what conditions your parents have taken out family liability insurance. Each insurance company has its own guidelines and rules. If you are not married, you are covered under the Luko family plan until you complete your vocational training.

Vocational training can be in-company training, school-based training (technical schools, vocational schools or vocational colleges), training in the dual system (apprenticeship in conjunction with vocational school and inter-company courses) or a course of study.

You can also complete several training phases in succession. If you first decide on a company-based training and then on a course of study, you will be insured through your parents until the end of your studies. There are many possible combinations. Do you want to put vocational training in between your Bachelor's and Master's degree? - No problem.

Entscheidest du dich erst für eine betriebliche Ausbildung und danach noch für ein Studium, besteht bis zum Ende des Studiums Versicherungsschutz über deine Eltern. The insurance cover ends when you are of age and start working between the training periods. (Secondary employment is possible during vocational training).

In addition, your co-insurance with your parents ends upon completion of your vocational training, unless you are officially registered with them.

This is the time when you should take care of your own liability insurance.

What damages does my private liability insurance cover?

Your personal liability insurance covers damage you cause to other people's property, including damage to rented property, personal injury and financial loss. Certain internet risks are also covered.

Here are a few examples:

  • You're working with a fellow student on a joint project. In the heat of the moment, you accidentally spill your coffee on his laptop.
  • Since you left your smartphone at home, you borrowed the phone from a fellow student and accidentally dropped it.
  • In order to get to class on time, you hurry to the university on your bike. In doing so, you take the right of way from another cyclist. There is a collision in which the other cyclist hits his head on the asphalt.

In all these cases, Luko will take care of the claims for you.

For which damages does my private liability insurance not pay?

There are some cases where your personal liability insurance does not pay for the damage caused. So watch out!

These include, for example:

  • Intentional damage, where you deliberately damage or destroy other people's property
  • Damage you cause to your own property
  • Damage to other persons who are covered by your private liability insurance in the family tariff
  • Complimentary damages, unless you have our "Top of the Topps" add-on.

What are complimentary damages?

Complimentary damages are damages that occur in the context of friendship services. A favor is when you do another person a favor and help them with something voluntarily and without payment. This includes, for example, helping with a move or renovation.

Another example of a favor:

Suppose you're watering the flowers for a fellow student while he's on a semester abroad. You stumble with the watering can, lost in thought, and tip the water over his new hi-fi system. In general, you are not liable for damage caused by favours. If you have chosen the "Top of the Topps" add-on,Luko will still settle the claim if you have a legitimate interest. Maintaining a good relationship with your fellow student is a legitimate interest. Otherwise the damage is not insured and you can decide yourself if you want to pay for it or not.

I have a dog in our shared apartment. Is it also insured?

If you are a dog owner, you need a separate dog owner liability insurance for your four-legged friend. Your personal liability insurance only covers damages caused by smaller tame pets such as cats and rabbits.

HaftetIs my personal liability insurance also liable for negligent behaviour?

In insurance cases, a distinction is made between simple and gross negligence. If you are not careful for a moment, it is simple negligence. Example: You are inattentive for a moment and knock the laptop off the table or tip coke over your fellow student's laptop.

If you are grossly negligent, it is possible for you to assess the danger. For example, you light candles and then leave the room. You are aware that a candle can fall down and cause a fire. You accept this risk. But you do not deliberately cause a fire. So there is no premeditation.

In short, your personal liability insurance protects you against both simple and gross negligence.

What is negligence?

Simple negligence is when you are clumsy or have an accident: You fail to pay attention for a moment, you fail to act with due diligence. You do not realise at that moment what the consequences may be.

Gross negligence means that you recognised a danger but were still not careful or ignored the risk. As suspected, damage will occur.

What benefits should I look out for in my liability insurance as a student?

Participation in company internships or in technical practical lessons (internships)

While you are taking part in company internships or practical training, you are covered by insurance. Frequently, internships or practical training take place at schools or universities. If something is accidentally damaged in the equipment, teaching materials or building, these damages are covered by insurance.

Holiday jobs/ work and travel abroad

If you have a holiday job during the school or semester break, you are insured during this time. This also applies to jobs that you take on during a Work and Travel stay abroad lasting a maximum of 12 months.

Which additional services does Luko offer?

Luko does not offer the classic additional insurances, but special additional modules. With these "toppings" you can individually extend your insurance coverage:

Best Performance Guarantee

Let's say you have a claim. But according to Luko's policy, it's not or only partially insured. If another insurer in Germany settles this claim, their benefits also apply to your contract with Luko.

This gives you the security to always enjoy the best possible insurance coverage. You do not have to change your contract just because a new benefit comes out, which your insurer does not yet offer.

Exemption from contributions in case of unemployment

Suppose you sign a private liability contract with Luko. To finance your studies, you have a permanent contract and work part-time (at least 30 hours a week). One year later you lose your job because you were dismissed for operational reasons. In this case you can have your contract set to "non-contributory".

The exemption from contributions begins as soon as you register as unemployed with the employment office. It ends when your unemployment ends, at the latest after one year.

Services despite liability limitations

In certain cases you cannot be held liable for any damage:

  • For example, because you were unconscious when the damage occurred,
  • In the case of unpaid assistance, for example when moving house (ie. damage caused by courtesy)

If you have chosen this additional protection, we will still provide it at your request. Because you may want to make good the damage, even if you are not legally obliged to do so, if only to maintain the friendship with your buddy.

An example: At a party, a fellow student asks you to help him set up the barbecue. While carrying it, you accidentally bump into the door and damage the frame. If you had a personal liability policy without the Top of the Topps, we would not be able to repair the damage. But with this topping you don't have to worry and your friend won't have to pay.

Aid for victims of violence

Friendly skirmishes, heated discussions or standing up for your best friend can sometimes end badly, it may not be your intention. Men between the ages of 14 and 29 with German citizenship are particularly often affected by a violent crime. Statistically speaking, they are 1.5 times more likely to be victims of violence than women. In the hope that something like this never happens, one can still protect oneself from it as a precaution. Especially if you know, for example, that you live in an unsafe area or see yourself as a provocative type.Victim protection assistance simply explained:

As a victim, you are insured with us if you have suffered permanent physical (not mental) damage as a result of the crime and if the Victims' Compensation Act entitles you to a victim's pension in accordance with §§ 30-34 of the Federal Supply Act.

The degree of the consequences of the damage is to be assessed according to the general effects of the functional impairments caused by the physical, mental or psychological health disorders recognised as the consequences of the damage, in all areas of life.

A violent act is a deliberate unlawful physical attack against you. This also includes sexual offences.

If you suffer permanent physical damage caused by violence inflicted on you and receive a victim's pension under the Victims' Compensation Act, we will pay you a one-off sum of up to 50,000 euros (victim's aid), depending on the amount of the victim's pension.

Restrictions / Excluded from insurance cover

  • Damage in connection with your own participation in criminal acts,
  • Damage resulting from physical attacks caused by the attacker through the use of a motor vehicle or trailer,
  • Primary and secondary psychological damage.

Is my flat-sharing community also insured in the private liability insurance?

That depends on which option you choose.

Luko offers two options:

  • Single-private student liability insurance covers only you.
  • With a family private liability insurance for students, you can insure yourself and your flat-sharing community. It is important that you form a domestic community and that you are officially registered at the same address.

How much should the insurance sum be?

An insurance sum of at least €10 Million is advisable. With a higher sum insured you are even better protected in case of an emergency. The maximum amount Luko insures is €30 Million. That's a very good coverage.

What is meant by "insured sum"?

The insured sum or sum insured is the maximum amount that the liability insurance covers. If you have caused more damage, you have to pay the difference yourself.

How much does a private liability insurance for me as a student cost per month/year?

The usual market price is between €80 and €120 annually. At Luko you can insure yourself with a private single liability insurance from €56.39 per year.

How can I save on my liability insurance as a student?

First, check if you are still covered by your parents' liability insurance.

One way to save is to take out liability insurance at the family rate. This allows you to insure yourself and your flat-sharing community in a single policy and you can split the fees. Find out whether your flatmates already have a private liability insurance or whether their parents are also insured.

One last savings possibility is the payment interval: If you pay your fees annually in advance, you will save another 5 percent with Luko, compared to the monthly payments.

Is a deductible useful for me as a student?

On the one hand, an excess reduces the insurance premium to be paid. This makes your liability insurance cheaper. On the other hand, in the event of a claim, you will have a financial burden.

To protect you from this, Luko does not offer you a policy with a deductible. This has two advantages for you:

  1. Our monthly and annual rates are student friendly.
  2. In case of a claim, you do not have to dig deep into your pocket, but you can rely on us completely.

Am I insured through my private liability insurance when I am abroad or studying abroad?

In many courses of study, a semester abroad is now a matter of course or even obligatory. Sometimes this is followed by an internship abroad. You should also be covered during this time. The private liability insurance for students at Luko will cover you for this time abroad.

Your permanent residence, however, must be in Germany. Outside the EU your insurance coverage is for a maximum of five years.

How do I proceed with a damage report?

Do not panic! The problem can be solved easily and quickly. In most cases, liability claims are property damage.

It is therefore best to proceed as follows:

1. Document the damage

Photograph the damaged/destroyed item from different angles. Ask the person concerned for their address and telephone number. You need both for your damage report.

Write down in keywords how the damage was caused. A chronological order is useful. Then you have a memory aid that will help you later to reconstruct the course of the damage.

Ask the injured party to keep the item. This is important if an expert from Luko comes by for an assessment or if the item has to be sent to Luko.

2. Do not comment on the question of guilt

Luko's insurance experts are examining the case to see if the claims for damages against you are justified.

If the claims are admissible, they will be settled. Your liability insurance fends off unjustified claims.

Unjustified claims for damages

Private liability insurance fends off unjustified claims for damages. So, as a policy holder you will enjoy passive legal protection. In case of a lawsuit, Luko bears the costs for your legal counsel, the experts and the court proceedings.

Do not offer the injured party any money, but explain that you will pass the case on to your insurance company. Luko evaluates the current value and the repair costs. Perhaps the value is below what is required of the person concerned.

3. Inform Luko about the damage

Get in touch with Luko immediately. It is best to contact your liability insurance company on the same day or on the following working day. You can submit your claim to Luko from your smartphone, tablet, or computer. Just log into your Luko account.

4. Fill in the damage report

The first step is to open the claim. To do this, go to your personal space, from the Luko app .

How do I report a claim?

  1. Log in to the application with your personal Luko account details.
  2. Once logged in, go to the "Insurance" tab (in the bottom menu)
  3. You will see the "Claims" tab at the top, click on it.
  4. In the "Claims" tab, scroll down the page: you will see the heading "Claim". Click on the type of claim that matches your situation, or on 'Other' if you don't know which category to choose
  5. If you have not yet authorised the Luko app to access your location, a window will open for you to do so. Click "Allow", this will open a window in your phone settings. Click "Ok", then "Allow".
  6. Answer our few questions: they help us understand what is happening to you. For each question: select the answer, or Write in the box provided, then click "Next" at the bottom right.
  7. Make a video of your damage (if you have any problems making it, our advice is here)

Once your claim has been registered, you will receive a confirmation message, and one of our managers will contact you for further information.

To follow the processing of your claim, you can do so directly in the application. In the "Claim" tab, your current file will appear in the small blue boxes.
